Eligibility: Contest is open to all persons (and groups of individuals where all members of the group meet the following criteria) (i) age 18 years or older as of the date of entry, (ii) residing in one of the following countries: United States, United Kingdom, Australia, Netherlands, Brazil, Canada (except Quebec), and Japan (iii) holding citizenship status or official work or student visas for the above countries. Employees, independent contractors, officers, and directors of Sponsor, its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, the judging panel, and the immediate family members and persons living in the same household of such persons, are not eligible to participate in the Contest. Categories & Judging: Each entry must meet the requirements specified in Section 4 of these Official Rules. Any non-conforming entries will be disqualified. Altered, defaced, mutilated, illegible, or incomplete Entry Forms are not eligible and will result in disqualification of such entry. Entries that contain any content that is pornographic in nature, lewd, or sexually explicit, in Sponsor’s sole discretion, will be disqualified. After each entry is screened for compliance with the entry requirements, it will be judged judges selected by the Sponsor. The judges’ decisions are final and binding. Each entry must be submitted in only one (1) of the four (4) categories listed below. Each of the four (4) categories will have one (1) Best in Category winner. Any individual or any group who has already won once in a category is not eligible to win in another category. Judges retain the right to reclassify entries from one category to another. Each entry shall be judged in its specified category based on the following criteria as determined in the sole discretion of the judges: 50% usefulness to the Breeze customer base, 25% originality and creativity, 25% overall polish and aesthetics. eLearning Application: Appropriate entries for this category include applications that showcase how a customer could potentially use the Sync SWF API in a virtual classroom, and are: (i) designed to assist remote trainers in facilitating a virtual classroom; (ii) generic tools that can be used in an educational environment; or (iii) targeted applications intended to facilitate learning on a specific topic. These applications should take into account the collaborative nature of Breeze meaning that Sponsor shall not consider entries that are standalone eLearning applications that do not utilize collaborative functionality.

Web Seminar Application: Appropriate entries for this category include applications that are: (i) designed to assist event managers in facilitating large virtual meetings; (ii) generic tools that can be used in a web seminar environment; or (iii) targeted applications that are meant to showcase how a customer could potentially use the Sync SWF API in a few-to-many web seminar scenario. These applications should take into account the collaborative nature of Breeze.

Team Collaboration Application: Appropriate entries for this category include applications that are focused on increasing the productivity and effectiveness of small groups of geographically dispersed teams. This could include applications that assist meeting hosts in conducting effective virtual meetings, generic tools that can be used in a team collaborative setting, or targeted applications that are meant to showcase how a customer could potentially use the Sync SWF API to create vertical or horizontal applications to be more efficient.

Ice Breaker/Gaming Application: Appropriate entries for this category include applications that are focused on providing interactive applications that help connect geographically dispersed users. This could include applications that help users connect virtually by mimicking a face-to-face interaction or by exploiting the medium to produce collaborative Flash software-based applications or games.

How to Enter: Entries must be submitted by using the Entry Form exclusively available from the Contest entry Web page at http://www.adobe.com/go/sync_swf_contest. Download the Sync SWF SDK at http://www.adobe.com/devnet/breeze/articles/intro_sync_swf.html, to create your application. To test your application, use the built in emulator that comes with the SDK, or at your option, signup for a free 15-day trial of Breeze to see it in action by going to http://www.adobe.com/products/breeze/trial. An original work, submitted to only one (1) of the four (4) Categories defined in Section 3 above. The work must be created solely with Flash® 8 or Flash MX 2004 software.

Entries must be submitted as a single .ZIP file containing the original .FLA files, the completed application files, and a README that includes a description of the application and any special instructions. If your file is over 5mb, you may email your file to syncswf@adobe.com, but you must complete the Web Entry Form, read and accept the Official Rules and click the “Submit Request” button on the bottom of this page in order for your entry to be valid.

For group entries, everyone who contributed to the entry must be listed on the Entry Form. One of the individuals who worked on the entry must be designated on the Entry Form as the lead team member (“Lead Team Member”).

Each entry must be submitted separately. Sponsor accepts no responsibility for entries that are lost or damaged in transit. Sponsor shall use reasonable care to prevent any loss or damage to entries received by Sponsor; however, Sponsor shall not be liable for direct, indirect, or consequential loss that results from the loss or damage to any entry. Unless prohibited by law, Sponsor's liability shall be limited to US$50.00.

Copyright Ownership
By submitting an entry by a sole creator, Contestant warrants that Contestant is the sole designer, creator, and owner of the entry, including all visual and auditory components, and further warrants that the entry does not contain information that is a) owned by anyone other than Contestant; or b) considered by Contestant's place of business or any other third party to be confidential. By submitting an entry by a group of creators, the Contestants warrant that they jointly designed, created, and own the visual and auditory entry and further warrant that the entry does not contain information that is a) owned by anyone other than Contestants; or b) considered by Contestants’ place of business or any other third party to be confidential.

Best in Category: One winner will be selected in each category. A total of four (4) prizes will be awarded: Best eLearning Application: US$5,000; Best Team Collaboration Application: US$5,000; Best Web Seminar Application: US$5,000; Best Ice Breaker/Gaming Application: US$5,000. In the event that a group entry wins one of these prizes, the group will receive a check for US$5,000 made out to the Lead Team Member to be split by the winning team members. Any individual or any group who has already won once in a category is not eligible to win in another category.

Honorable Mention: Contestants maybe awarded an Honorable Mention and will have their names and entries posted on our winner’s list website. Honorable Mention recipients will not receive a cash prize.
All prize values are in U.S. Dollars. Because this is a contest of skill, winning is dependent upon the quality of entries received. All prizes will be awarded unless there are fewer eligible entries for a Category than prizes for that Category, or the judges determine that the quality of entries does not warrant a prize. No alternative prize, cash, or other substitution is allowed except by Sponsor in the event of prize unavailability. Prizes are non-assignable and non-transferable. All federal, state, provincial, and local taxes are the sole responsibility of the winners.

Winner Notification: Entries will be judged between September 30, 2006, and October 6, 2006. Best in Category winners and Honorable Mention recipients (collectively referred to as “Finalists”) will be notified by U.S. mail and on the winner’s list website, and will have ten (10) days from receipt of such notification to acknowledge Finalist status, by U.S. mail or courier. Sponsor is not responsible for, and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify Finalists. If a selected Finalist cannot be contacted, is ineligible, fails to acknowledge status, or fails to comply with any term or condition of these Official Rules, prize may be forfeited and an alternate Finalist may be selected. As a condition of receiving a prize, Best in Category winners will be required to sign and return certain documents including a publicity consent and liability release, , a declaration of eligibility, and a license agreement, as applicable , all within ten (10) days of receipt by winner. Additionally selected Honorable Mention recipients will be required to sign and return certain documents including a publicity consent and liability release, a declaration of eligibility, and a license agreement, as applicable all within 10 days of notification that the individual has been nominated. If a group entry is selected as a Finalist, each individual will be required to sign and return certain documents including a publicity consent and liability release, a declaration of eligibility, and a license agreement, as applicable all within 10 days of notification as a Finalist. Each Contestant (and each member of a Contestant that is a group) agrees that if his, her or its entry is selected as a winning entry, as a condition of receiving a prize, Contestant (and each member of a Contestant that is a group) shall sign a license agreement granting to Sponsor a royalty-free, non-exclusive, perpetual, sublicensable, worldwide license to use, reproduce, edit, adapt, sublicense, publicly perform, publicly display, modify for purposes of publicly performing and publicly displaying, prepare derivative works of and distribute through multiple tiers of distribution and in any manner or form, now known or later developed, the winning entry, in whole or in part for the purposes of marketing, advertising and promoting Sponsor products, and for inclusion in and distribution with Sponsor branded products and services. Each Contestant further agrees to execute any and all documents necessary to effectuate such license.

General Terms and Conditions: Sponsor is not responsible for and shall not be liable for: (i) lost, late, delayed, damaged, incomplete, illegible, unintelligible, or misdirected entries; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, partial, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of a prize, or acceptance, possession, or use of a prize, or from participation in the Contest; (vi) any printing or typographical errors in any materials associated with the Contest; or (vii) any regional, state, or local laws or regulations violated during the creation of the entries by the entrant(s). Sponsor reserves the right to suspend, cancel, or modify the Contest if fraud or technical failure corrupts the administration, security, or proper play of the Contest, as determined by Sponsor in its sole discretion. Each Contestant agrees to release and hold Sponsor harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Contest or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, property damage, and claims based upon intellectual property infringement, publicity rights, defamation, or invasion of privacy. Each Contestant agrees that Sponsor's only obligation is to submit entries from eligible Contestants to the judges according to the procedures and criteria set forth in these Official Rules, and award the prizes set forth herein to winners, subject to the terms and conditions herein. Contestant agrees that Sponsor's obligation is fair and adequate consideration for any entry submitted, and that Contestant is not entitled to and shall not seek any further compensation.
Each Contestant (including each member of a Contestant that is a group) agrees that by submitting an entry, he or she allows the use of his or her personal data, name, likeness, and/or voice in publicity or advertising relating to the Contest and/or any use, promotion, and distribution of such Contestant’s entry without compensation. Further, if the Contestant has agreed to receive communications from Adobe and third parties in the opt-in section above, then Adobe may use the Contestant’s personal information for such purpose. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Contestant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.
