You are partly wrong in your accusations!
Poor guy is a german and his german PS creates layers called EBENE instead of LAYER. So it is not his fault, but the not so intelligent translation efforts of ADOBE. So now ALL the wonderful english actions here would not work for the german version and vice versa. Here my Idea how to use this action: Rerecord ALL action steps which include the Word EBENE. But still some things are not well explained and the action itself needs improvement
