Official Rules

Eligibility
Must be 18 years old or older. Must be a legal resident of the 50 United States and D.C., except AZ. Employees of Adobe Systems Incorporated or its affiliated companies and their immediate families (defined as parents, children, siblings, grand parents) and all those with whom such employees are domiciled, are not eligible. Residents of ARIZONA are ineligible.

Timing
Contest begins at 12:01:01 a.m. EST on January 19, 2000, and ends at 11:59:59 p.m. EST on February 19, 2000 (the "Contest Period"). All entries must be received by 11:59:59 p.m. EST, February 19, 2000. Entries received prior to or after the Contest Period shall be disqualified. Sponsor reserves the right to cancel the Contest before the end date for any reason.

How to Enter
To enter, send us a graphic image that accurately captures the neo-postmodern futuristic zeitgeist of the year 2000 and beyond (the "Contest Theme"). To do so, you need to go to www.adobe.com/contests/milldesgnsub.html, complete the entry form and attach your image. Your graphic image must be a 5x7 inch (either horizontal or vertical) 144 pixels/inch jpeg. The text of your e-mail submission must also provide your name, age, and legal residence. LIMIT: One entry per person. Entrant must have all rights to the entry and such entry may not be subject to the rights of any third party.

Criteria
All eligible entries will be judged according to the following equally weighted criteria:

(a) Theme (25%) – The Theme criteria judges the appropriateness of the submitted graphic design to the Contest Theme;

(b) Concept (25%) – The Concept criteria judges the submitted graphic design's humor, originality, creativity, ability to entertain;

(c) Artistic Value (25%) – The Artistic Value criteria judges the submitted graphic design's overall composition and the effectiveness of the image in communicating the Contest Theme.

(d) Software Skills (25%) – The Software Skills criteria judges the effective use of digital tools used in rendering the submitted graphic design. Use of Adobe Systems Incorporated products are not required to enter the Contest and use or non-use of such products will have no effect in judging Contest submissions.

In the event of a tie, there will be a playoff among all tied entrants using the same criteria.

Judging
Entries will be judged by a panel of designers, web editors, digital culture critics, and artists selected by Adobe Systems Incorporated (the "Judges"), whose decisions are final with regard to all matters related to the contest. The Judges will evaluate entries as they are received. Prizes One (1) Grand Prize: A 3-day class at Russell Brown's Art Director's Invitational Master Class (April 12-15) in San Jose, CA. Includes one (1) round-trip, coach-class airline tickets on carrier and route of Sponsors' choice for travel from major airport in the continental United States closest to winner's home residence to San Jose, CA. Carrier's regulations and conditions apply. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Seat selection and timing of trip subject to availability. Also includes standard hotel accommodations for two (2) nights; a lunch with Russell Brown; a Designers Suite of Adobe software. All other expenses and costs, not expressly listed above including but not limited to meals, taxes, tips, entertainment, transfers, and transportation to airport to and from home residence and any other expense or cost not expressly included above are the winner's sole responsibility. MUST BE ABLE TO TRAVEL ON DATES SPECIFIED BY SPONSOR. No refunds or credits allowed. Prizes are nontransferable and cash or other substitutions are not allowed except by Sponsor in the event of unavailability of a prize, unless prohibited by law. Applicable taxes are the sole responsibility of the winner.

Terms/Conditions
By submitting an entry, entrant grants Sponsor the royalty-free right in perpetuity to reproduce, publish electronically on the Internet, edit and use entrant's design in any media without compensation to the entrant. By participating in the Contest, entrant waives the benefit of any provision of law known as "moral rights" or "droit moral" or any similar or analogous law or decision in any country of the world. Entrant hereby agrees not to instigate, support, maintain or authorize any action, claim or law suit against Sponsor or its affiliates, or any other person, on the ground that any use of the entry or any derivative works infringe any of entrant's rights as author of the entry, including, without limitation, copyrights and moral rights or "droit moral." Submission constitutes entrant's consent, or if a minor, parent or legal guardian's consent, to use entrant’s name, hometown or likeness, except where prohibited by law, without further compensation for advertising or publicity purposes. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of these Official Rules and of various laws, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law. Entrant will indemnify Sponsor for any damages suffered by Sponsor resulting from violations of the Contest Rules by entrant. Sponsor is not responsible for lost, late, incomplete, failed, partial or garbled computer transmissions; or for technical failures of any kind, including but not limited to electronic malfunctioning of any network, hardware or software or by any human error which may occur in the processing of entries. To be declared a winner, selected entrants may be required to sign an Affidavit of Eligibility or, in Canada, a Declaration of Compliance with Contest Rules, and a Release of Liability Form and return same within 14 days of being delivered or the prize may be forfeited. Sponsor is not responsible for any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest. SPONSOR RESERVES THE RIGHT TO CANCEL OR MODIFY THE CONTEST IF FRAUD, TECHNICAL FAILURES OR ANY OTHER FACTOR BEYOND SPONSOR'S REASONABLE CONTROL IMPAIRS THE INTEGRITY OF THE CONTEST AS DETERMINED BY SPONSOR IN ITS SOLE DISCRETION. Unless you indicate otherwise on the entry form, Sponsor will only use personally identifiable data about entrants obtained from the Contest entry forms for the administration of the Contest and for Sponsor's own internal market research. Non-personally identifiable information about entrants in the aggregate may be shared with third parties. The data will be kept at Sponsor's office in San Jose, CA, USA. Any requests regarding the information you have supplied, may be submitted in writing to that office. Except where prohibited, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or any prizes awarded, other than relating to the administration of the Contest or the determination of winners, shall be resolved individually without resort to any form of class action and exclusively by arbitration under the Commercial Arbitration Rules (January 1999) of the American Arbitration Association in San Francisco, California, U.S.A.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including only costs associated with entering this Contest but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages and any and all rights to have damages multiplied or otherwise increased. Subject to all applicable federal, state, and local laws. Void in AZ and where prohibited.
