Macromedia Flash Lite Content Contest

NO PURCHASE NECESSARY

  1. DESCRIPTION OF THE CONTEST: The Macromedia Flash Lite Content Contest is a skill promotion designed to encourage the creation of content using Macromedia Flash Lite. Entrants must download Macromedia Flash Lite 1.1 Content Development Kit ("CDK") at http://www.macromedia.com/devnet/devices/flashlite.html. Entrant must also send an e-mail to flashlite_contest@macromedia.com to request to be part of the Macromedia Beta Program. If the entrant is approved to participate in the Macromedia Beta Program, Macromedia will send an e-mail invitation containing a link to the Macromedia Beta website at http://mmbeta.macromedia.com/nda.cfm?beta=sahtisebeta. Entrants must register on the Macromedia Beta website before or during the Promotion Period. Once the entrant has successfully registered in the beta program, the entrant will receive instructions to submit the applicable International Mobile Equipment Identifier ("IMEI") number to kiwi@macromedia.com to receive a version of the Macromedia Flash Lite 1.1 compatible with the applicable IMEI number. All entrants must be registered participants of Macromedia's Beta Program. Entrants must use Macromedia Flash Lite 1.1 CDK to create content.
  2. HOW TO ENTER: Submissions will be accepted from 12:01 AM Pacific Time November 1, 2004, through 11:59 PM Pacific Time February 1, 2005 (the "Promotion Period"). Entrants must e-mail content for submission to flashlite_contest@macromedia.com. The Subject Line of the e-mail must read: "Flash Lite Contest Submission." Entrants must include personal contact information in the body of the e-mail, including (1) name; (2) company; (3) phone; (4) e-mail; (5) name of submitted file. Content submissions cannot exceed 300K total size. Content and related support files must be zipped (compressed prior to submission).

    Macromedia is not responsible for any errors in contest related materials, or lost, late, misdirected, damaged, incomplete, or illegible entries. You may submit more than one entry, but you must separately submit each entry and no duplicate entries will be accepted.

  3. ELIGIBILITY: This contest is open to entrants who are 18 years of age or older. Void where prohibited by law. All winners will be required to execute an affidavit swearing to compliance with these eligibility requirements. Employees of Macromedia, its parents, subsidiaries, affiliates, agencies and assigns, and their immediate family members (spouse and parents, children and siblings, and their spouses) as well as individuals living in the same household of each are not eligible. The Contest is subject to all applicable federal, state, and provincial laws and regulations.
  4. GOVERNING LAW: This contest is subject to, and governed by, the laws of the United States.
  5. CATEGORIES/JUDGING: Macromedia will choose one (1) winner for each of the following categories:

    1. Most Innovative Use of Flash Lite
    2. Best Game
    3. Best Interactive Content
    4. Best Educational Application
    5. Best Business Application
    6. Best Productivity Application
    7. Best Animation

    Winners will be chosen by Macromedia Judges based on the following criteria:

    1. Usability
    2. Presentation
    3. Functionality
    4. Usefulness

    There will be one (1) grand prize winner with the highest total score. Judging will take place the week beginning February 2, 2005, and winners will be announced on or around February 7, 2005. The Judges committee will be comprised of Flash Lite experts from Macromedia's Mobile & Devices Marketing, Product Management, and Engineering teams.

  6. PRIZES AND APPROXIMATE RETAIL VALUES: Seven First Prize: One (1) AppleĀ® iPodĀ® (Approximate retail value ("ARV") $299 USD) will be awarded to the winner of each category. One Grand Prize: one (1) grand prize winner will receive a Sony PFM-42V1 Plasma Television, Widescreen 16:9 Format (ARV: $2,800 USD). Actual value may vary based on timing and point of departure. Any and all taxes, costs, and expenses associated with receipt or use of any prize, including duty (where applicable), are the sole responsibility of the winner. By entering, you agree to be bound by these Official Rules, and the decisions of Macromedia, which shall be final in all respects. Prizes will be shipped via standard ground shipping by an internationally recognized carrier. Winners must provide a valid shipping address and may not use a PO Box or address not serviced by an internationally recognized shipping carrier. Macromedia is not responsible for incompatible electrical connections or voltage standards associated with the winners. Sponsor reserves the right to substitute a prize with a similar prize of equal or greater value in the event of unavailability.
  7. CONDITIONS OF PARTICIPATION: Winners will be required to sign and return an Affidavit of Eligibility, a Liability Release, and, where legal, a Publicity Release within 14 days of first attempted notification. In the event of non-compliance with these requirements, Winner will be disqualified and an alternate winner will be selected at Macromedia's discretion. Macromedia and its suppliers retain all right, title and interest, including all copyright and intellectual property rights, in and to, the Macromedia Flash Lite software and all copies thereof. By entering, entrants also agree to the use of the winner's name and likeness for purposes of advertising and promotion without additional compensation, unless prohibited by law. By entering, participants release and hold harmless Macromedia, its parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or injuries, loss or damage of any kind arising from or in connection with participation in this contest or acceptance or use of any prize.
  8. ASSIGNMENT OF RIGHTS: By entering, entrants represent and warrant that they have the right to grant Macromedia the rights set forth above and hereby warrant that (1) the Material is original and they are the sole author of and owner of all rights including copyrights to the entry and that the entry is not subject in whole or in part to claims of ownership of others or (2) the entry is subject, in whole or in part, to claims of ownership and copyright by others but that the entrant has the right to grant to Macromedia the rights set forth above. Entrants retain any and all rights of ownership, intellectual property rights and all other rights entrant may have in and to the entry. Notwithstanding such ownership rights, by entering, entrants personally and on behalf of their company grant and assign to Macromedia, its successors and assigns and those acting under its direction, a perpetual, non-exclusive worldwide right and license, but not an obligation, free of any charge or compensation, to use entries, and all rights subsidiary to and derivative from the entries, for the development and incorporation in, Macromedia products or services, in any medium now known or invented in the future. Moreover, by entering, entrants personally and on behalf of their company, hereby grant to Macromedia, its successors and assigns and those acting under its direction, for a period of one (1) year, exclusive, worldwide rights and a license, but not an obligation, free of any charge or compensation, to use, edit, copy, distribute and publish all or part of the entry, and all rights subsidiary to and derivative from the entry, in any medium now known or invented in the future, for promotional, advertising or demonstration purposes for Macromedia's products or services or for Macromedia generally.
  9. INTERNET: Sponsor assumes no responsibility for technical, hardware or software failure of any kind, for lost network connection or for garbled computer transmissions. If for any reason, programs are not capable of running as planned, including infection by computer virus, bugs, tampering, and unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect administration, security, fairness, integrity, or discretion, Sponsor reserves the right to cancel, terminate, modify or suspend the Promotion. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, computer equipment, software, failure of any e-mail to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or any website, or any combination thereof, including any injury or damage to the participant's or any other person's computer related to or resulting from participation or downloading any materials in this promotion. If for any reason your submission cannot be viewed or is not capable of running as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud or technical failures, Sponsor assumes no responsibility. Sponsor is not responsible for any problems or technical malfunctions.
  10. PUBLICATION OF WINNERS: After the contest has concluded, the winners will be notified by e-mail on or about February 7, 2005. A list of winners may also be obtained by sending a self-addressed stamped envelope to Macromedia c/o Mobile & Devices Marketing, Macromedia, 600 Townsend, San Francisco, CA 94103, to be received by February 28, 2005.
