Components

IMPORTANT: BY USING THE COMPONENTS AS SET FORTH BELOW, YOU ARE AGREEING TO BECOME BOUND BY THE TERMS SET FORTH BELOW. NO OTHER LICENSE IS PROVIDED TO YOU WITH RELATION TO THE COMPONENTS EXCEPT AS SET FORTH BELOW OR AS OTHERWISE AGREED TO BY YOU AND MACROMEDIA.

IN ORDER TO USE MACROMEDIA FLASH, YOU HAVE AGREED TO AN END USER LICENSE AGREEMENT (“EULA”). NOTWITHSTANDING CONTRARY RIGHTS SET FORTH IN SECTION 2(f) OF THE EULA, .

Solely with regard to Sample Application Code that are Components or Components Framework (defined below), you may modify the source and compiled form of the Components and distribute the Components and Components Framework with those modifications only if all of the following conditions are met:

(1) you only distribute the source code or compiled form of the Components Framework with the Developer Components (defined below) and only to support the Developer Components;

(2) you do not distribute any Developer Component that does not include a Material Improvement (defined below);

(3) except as set forth below, you do not use Macromedia's name, logos or other Macromedia trademarks to market your application, provided that you may include referential uses to Macromedia and Flash pursuant to Macromedia’s published trademark guidelines, currently set forth at http://www.macromedia.com/help/trademarkguideline.html; and

(4) you must ensure that any sublicensee of yours exercising the above rights complies with all restrictions and obligations set forth herein.

(5) you shall not delete or in any manner alter the copyright notices, trademarks, logos or related notices, or other proprietary rights notices of Macromedia (and its licensors, if any) appearing on or within the Components or Components Framework, or any documentation relating to the Components or the Components Framework, provided that you must cause any modified files to carry prominent notices stating that you changed the files.

You may distribute up to 50 non-comment lines of code from the Macromedia Flash Components Framework without Material Improvement solely for illustration or support purposes.

You agree to indemnify, hold harmless and defend Macromedia from and against any loss, damage, claims or lawsuits, including attorney's fees, that arise or result from the use or distribution of your application, the Components Framework or the Developer Components.

For purposes of this agreement, the following definitions shall apply:

“Components” shall be defined as any of the reusable .SWC files provided by Macromedia and displayed in the Components panel of Macromedia Flash.

“Components Framework” shall be defined as the set of source files that defines the class hierarchy used to create Components.

“Developer Components” shall be defined as Components that are built consisting partly of the Components Framework source code and partly of user’s Material Improvement to extend the Components Framework.

“Material Improvement” shall be defined as perceptible, measurable and definable improvements to the Components Framework or a Component that provide extended or additional functionality that add significant business value to the components.

Except as set forth herein, the EULA, including Section 2(f) of the EULA, shall remain in full force and effect.

Device images provided with this software are provided for simulation purposes and there is no promise or guarantee that the actual device models reflected herein implement Flash technology when commercially shipped by the device manufacturer.
