By using the Premier League images and/or other Premier League assets (“Assets”) provided to you in Adobe Express by Adobe, you agree to use such Assets solely to create non-commercial fan art (“Fan Art”) subject to the terms set forth below (the “Guidelines”), in addition to any terms that govern your use of Adobe Express. The terms of these Guidelines will control to the extent the terms of these Guidelines conflict with any other terms you have agreed to with Adobe that govern your use of Adobe Express. You acknowledge and agree that all rights in and to the Assets are the sole property of the Premier League (“The PL”) and its licensors.

You acknowledge and agree that Adobe, in its sole discretion, and without notice, may terminate your license to the Assets if it determines, in its sole discretion, that your use of the Assets or Fan Art fail to comply with the Guidelines. If Adobe terminates your license, then you irrevocably agree to remove, and Adobe and/or the PL may request the removal of, any such Fan Art from any social media accounts and/or any locations/platforms where your Fan Art is made available/featured upon notice of termination.

You hereby further agree, represent and warrant, as applicable:

1. Your Fan Art has not altered the Assets other than as expressly provided for in Adobe Express.
2. You will not use the Assets and/or Fan Art for any commercial, promotional, advertorial, endorsement, advertising, gambling, betting, gaming or merchandising purposes.
3. Your use of the Assets will not portray The PL, any of The PL’s clubs and/or players, or Adobe in a false, negative or derogatory light.
4. Your use of the Assets is for promotional purposes only in connection with non-commercial support of the PL.
5. You will not represent, expressly or impliedly, that the Assets and/or Fan Art are your original work or that you are the author, creator, or exclusive owner of any Assets and/or Fan Art. You further agree not to create, distribute, or exploit any work that consists predominantly or substantially of the Assets and represent such work as independently created by you. Without limiting the foregoing, you shall not create artwork, designs, or other materials derived primarily from Assets and claim authorship or ownership of such materials beyond the rights expressly granted under these Guidelines.
6. Your Fan Art and any of the social media accounts and/or locations/platforms where Your Fan Art is made available/featured will not contain material that: (a) is unlawful, fraudulent, libelous, defamatory, in violation of any applicable regulations (including for sports content, any restrictions or credentials issued by a sports league or governing body) or sports codes, or otherwise objectionable; (b) infringes Adobe’s, The PL’s or any third party's intellectual property or other rights; (c) could be considered harmful, obscene, pornographic, sexually explicit, indecent, lewd, violent, abusive, profane, insulting, threatening, harassing, hateful or otherwise objectionable; (d) encourages or otherwise depicts or glamorizes drug use (including alcohol, cigarettes, and vaporizing pens); (e) encourages or otherwise depicts gambling or other regulated activities; (f) promotes violence or characterizes violence as acceptable, glamorous or desirable; (g) harasses, victimizes, degrades, or intimidates an individual or group of individuals on the basis of religion, race, ethnicity, sexual orientation, gender, age, or disability; (h) includes any appeals for funds; (i) references or promotes any religion; (j) references or promotes any political content; (k) references or promotes the online sale or resale of tickets or the online sale of Premier League merchandise or services ; or (l) otherwise could be considered inappropriate, unsuitable or offensive, as determined by the PL or Adobe in its sole reasonable discretion.

All rights in the Assets not expressly granted in these terms are reserved by Adobe and The PL and its licensors. Your use of the Assets in your Fan Art will not create or imply a relationship between you and The PL or Adobe. For the avoidance of doubt, your use of the Assets to create Fan Art will not affect, diminish, or otherwise alter The PL and its licensors’ ownership of, or rights in, the Assets, which will at all times remain the sole property of The PL and its licensors.
